The Site is owned and operated by CAL MUTUAL INC., a California corporation. The term “us,” “we” or “our” refers to the owner and operator of this Site. Our Privacy Policy also governs your use of the Site. If you do not want to accept and agree to these Terms or the Privacy Policy, you must exit the Site. Note that we may revise these Terms every once in a while whenever we feel it is appropriate, without notifying you. If you continue visiting our Site after we have published the revised Terms on this page, this constitutes your acceptance of the changes. So, please check this page periodically to take notice of any changes we made. If you do not agree with any changes, you must exit the Site. 2. VENUE
  1. Neutral Venue. com is a real estate search website. The Site is a neutral venue. WE DISCLAIM ALL LIABILITY ARISING OUT OF OR RELATED TO LISTINGS, INTERACTIONS AND TRANSACTIONS OF THE SITE USERS. All Site content remains the sole responsibility of its provider; we are not liable for any content available on or through our Site.
  2. Third Party Sites. The Site may contain links to third party websites that are not owned or controlled by us. We assume no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, the Site will not and cannot censor or edit the content of any third-party website. You acknowledge that we will not be liable for any and all claims, demands and damages of any kind and nature arising out of or in any way connected from any and all potential liabilities arising from the use of any third-party website. We cannot guarantee the availability or performance of any third party services used to support the Site. Such third party services may change their operations without notice to us. Therefore, we shall not be liable for any outages, version changes, delivery delays, failures, bugs, or termination of third party network service. Third party networks have their own terms and conditions of use, and you must comply with any terms and conditions provided by any third party network.

You obtain no interest in that Intellectual Property, provided, however, that you may download and view or print a copy of materials on this Site for personal use as long as you do not modify any content (including any copyright notice) in any way. All rights not expressly granted under these Terms are reserved by us. Unless expressly stated otherwise, you shall not copy, reproduce or replicate any Intellectual Property. We have the right but not the obligation to monitor and edit or remove any content submitted by users. We take no responsibility and assume no liability for any content posted by users or any third party.
  2. License to Your Content. By transmitting or uploading any content to our Site, you grant us a perpetual, unlimited, irrevocable, royalty-free, worldwide license to use, reproduce, adapt, display, perform, modify, transmit, translate, distribute, and create derivative works of your content; to make, have made, sell or otherwise distribute any of your submitted content. You further represent and warrant that you have the right, title, and/or authority to grant such license to us.
  3. Copyright Infringement Claims. Unauthorized copying, distribution, modification, public display, or public performance of copyrighted works is an infringement of the copyright holder’s rights. You agree that you will not use our Site to infringe anyone’s intellectual property rights. We will investigate copyright infringement claims if they are reported to us to info@kizzow.com
4. YOUR OBLIGATIONS By using this Site, you represent, warrant and agree that:
  1. You are 18 years of age or older.
  2. You will provide valid payment method information when necessary and pay all sums due when due.
  3. You will not create duplicate accounts and you will not share your account with anyone. You are solely responsible for all activity that occurs under your account.
  4. Our Site may contain typographical errors or other inaccuracies.
  5. Submission of misleading listings, reviews, comments, articles or other content may result in account termination. We may reject or erase or edit any content submitted for any reason without prior notice to you, within our sole reasonable discretion.
  6. You will only submit true, complete and not misleading information to the Site. All content you submit to our Site is free of third party intellectual property claims and contains no vulgar, profane, defamatory, abusive, racist or hateful language or expressions.
  7. Our Site content may not be copied for republication, either online or on paper, without our prior express written permission. However, you can share Site content via built-in social sharing buttons.
  8. You will not submit unsolicited bulk or commercial messages (“spam”) to our Site, other users or anyone else. Any unsolicited message must also not direct the recipient to any third party site or other resource.
  9. You will only use the Site for legal purposes and you will remain responsible for complying with all laws and regulations applicable to your use of the Site.
  10. We have the right to refuse access, service or disable your account on our Site at any time for any reason or no reason without notice, explanation or liability of any kind.
  11. You may not use any web spiders, bots, indexers, robots, crawlers, harvesters, or any other automatic process to access, acquire, copy or monitor any portion of the Site or any content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any content.
  12. You will not interfere with the proper working of the Site. You will not impersonate any other person or entity, submit any false, defamatory, offensive, harassing material, or any material that violates another party’s rights of privacy and publicity.
5. REMEDIES FOR BREACH OF THESE TERMS
  • We may take any action that we deem necessary or appropriate if we believe that any user violates the Terms of Use, infringes any intellectual property right, privacy right or confidentiality principles, threatens anybody’s personal safety or uses offensive language. We may: (i) disclose user’s identity to law enforcement agencies, to any third party claiming violation of their intellectual property or privacy right, (ii) block user’s IP address, notify user’s Internet Site Provider, (iii) suspend or terminate any account on our Site (iv) moderate any content submitted to us, (v) take any other action provided for in these Terms of Use or available under equity or law.
  • Since we cannot ensure that all material submitted to us is accurate and free of third party claims, we assume no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party.
6. DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY

INDEMNIFICATION You agree to defend, indemnify and hold harmless our company, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Site; (ii) your violation of any provision of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your user submissions caused damage to a third party. 8. GOVERNING LAW & ARBITRATION These Terms and any action related thereto will be governed by the laws of California, without regard to its conflict of laws provisions that would result in application of any other law. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall be conducted in San Diego, CA. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties. 9. GENERAL
  1. Electronic Communications. You agree that all notices or other communications regarding your account and/or your use of the Site (“Communications”), may be provided to you electronically and you agree to receive all Communications from us in electronic form. You may print a copy of any Communications and retain it for your records. All electronic Communications will be considered just as legally binding as if they were in paper form. You may revoke your consent to receive Communications electronically, but if you revoke your consent to receive Communications electronically, we reserve the right to terminate your right to use our Site.
  2. Hyperlinks. You may link to our Site, as long as this is done in a fair way that does not negatively affect our reputation or business and does not suggest any form of association where there is none. We reserve the right to request that you withdraw any link and you agree to cooperate with us in causing any unauthorized framing or linking to terminate immediately.
  3. Assignment. We may transfer, assign or subcontract the rights, interests or obligations under these Terms, at our sole discretion, without obtaining your consent.
  4. Severability. Should any part of these Terms of Use be rendered or declared invalid by an appropriate authority, such invalidation of such part or portion of these Terms of Use should not invalidate the remaining portions thereof, and they shall remain in full force and effect.
  5. No Waiver. Enforcement of these Terms of Use is solely in our discretion, and failure to enforce the Terms of Use in some instances does not constitute a waiver of our right to enforce them in other instances.
  6. Prevailing Language. In the event of any discrepancy between the English original version of these Terms and any foreign language translation, the English version prevails.
10. Concierge Real Estate Services Details Kizzow Concierge Real Estate Services include the following services, but are not limited to only these services.
  1. Buyers agent NET commission received at closing is refunded to the buyer / borrower at closing less a $4000 flat fee and any other fees. Additional refund details are in Section 14e of these terms and conditions.
  2. Writing the initial offer and all counter offers from a Kizzow agent or Kizzow referred agent.
  3. Buyer/borrower will get a dedicated live agent to Manage the transaction through closing.
  4. A dedicated agent will make ONE visit to any ONE property. Additional visits to any property including the first or any additional properties are $500 each visit to be paid to agent from the cooperating agents commission upon closing. This will result in a lower refund to the buyer.
  5. Assisting in appraisal and inspection.
  6. Closing and compiling closing docs for buyers records.
  7. Online property search capability and agent assistance creating and managing property searches.
  8. Phone and online access to buyers/borrowers Kizzow agent and team.
  9. Does NOT include touring and showing buyer/borrower potential properties. This is the buyer/borrower responsibility to tour properties PRIOR to making offers with a Kizzow agent. If the buyer/borrower needs a full service agent, they can use the Kizzow client appreciation refund program detailed in section 14a-e of these terms and conditions.
Concierge Real Estate Services cannot be applied in conjunction with The Kizzow Client Appreciation Refund or combined with any other Kizzow Refund program, used together in whole or in part. 11. MLS Terms of Use In order to allow you to view homes and their data, our MLS data providers require you to acknowledge that you’re considering Kizzow to become your real estate agent. Before viewing any real estate content made available through Kizzow, you must acknowledge:
  • You are agreeing to work in the capacity of a consumer-broker relationship with Kizzow as defined by applicable state law. You have no obligation to work with Kizzow and you can cancel your account with Kizzow at any time. Any information you obtain from the Redfin website is intended for your personal use and cannot be redistributed or retransmitted for any commercial use.
  • You will not copy, redistribute, or retransmit any of the information provided.
  • You understand and acknowledge that the individual multiple listing service (MLS), supplying the property data, owns such data and you acknowledge the MLS’s copyright to such data.
  • You have a bona fide interest in the purchase or sale of real estate on the Kizzow website.
  • You understand that the information from MLS sources is deemed reliable but not guaranteed.
12. Make an Offer Tool / Service Details Kizzow Make an Offer Tool / Service include the following services, but are not limited to only these services.
  1. A self-service option on Kizzow.com for buyers/borrowers to submit property buying offers to a Kizzow agent or Kizzow referred agent.
  2. A live agent to review, submit and represent you and your offer on your behalf.
  3. Can be used with any Kizzow refund program. See section 14a-e of these terms and conditions for additional refund programs and details.
  4. Make and submit as many offers as a client would like to make.
  5. Does not include an agent to tour properties unless applied with the Kizzow 50% Client appreciation program detailed in section 14a-b of these terms and conditions.
  6. Offers can only be submitted by a Kizzow / Cal Mutual Agent or other registered partner agent. Can be used by or with any outside agent.
13. Get approved / Mortgage application Details Kizzow Get approved / Mortgage application Service include the following services, but are not limited to only these services.
  1. Complete and submit a full or partial mortgage application
  2. Get a loan approval
  3. Work with a dedicated licensed loan officer.
  4. Track the loan process and upload documents
  5. Work in conjunction with your dedicated real estate agent and loan officer.
  6. Update loan approvals and purchase offers.
  7. Can be used with any Kizzow refund program.
14. Refund(s) Details a) Kizzow Client Appreciation Refund *Final refunds will ALWAYS vary from examples and any refunds presented anywhere on Kizzow.com or it’s advertising. **Buyer/borrower must use Kizzow / Cal Mutual for both real estate and mortgage services on the same transaction to buy a property and close the transaction. Non Kizzow / Cal Mutual mortgages are not applicable to any Kizzow refund programs. This includes any mortgage funded by any other company other than Cal Mutual Inc, Cal Mutual or Kizzow. A predetermined fixed percentage of the buyers agent commission is refunded to the buyer/borrower that use Kizzow / Cal Mutual for BOTH their real estate purchase and mortgage on the same transaction to buy a property. Refund is calculated by each individual property sale purchase price multiplied by the FINAL buyers agent commission minus any transaction fees then multiplied by a predetermined fixed percentage. Refund Example: $500,000 purchase x 3% Gross buyers agent commission -$350 Transaction coordination (ex: possible transaction fee) = $14650 NET commission x 50% = $7325 refund. Final commissions and refunds WILL vary. Kizzow / Cal Mutual Client Appreciation Refund predetermined fixed refund percentages and fees:
  1. Final NET buyers agent commission on the transaction above 2% or greater to qualify for a refund of 50% of the final buyers agent commission.
  2. Final NET buyers agent commission from 1.01% -1.99% and properties under $250,000 qualify for reduced refund of 35% of the final buyers agent commission.
  3. Final NET buyers agent commissions of 1% or less and properties under $250,000 are only eligible for a $500 max refund.
  4. Final NET buyers agent commissions of $2000 or less are NOT eligible for a refund.
Refunds will vary on each transaction calculated by the final buyers agent commission. The average MLS listed buyers agent (cooperating broker) commission ranges from 1% – 3%, but can be more or less depending on the MLS listed buyers agent (cooperating broker) commission. Commission limits and refund limits do apply. Refund is calculated by the NET buyers agent commission. Net commission is… Total FINAL buyers agent GROSS commission less any fees associated with the transaction paid by or from the buyers agent or agent, loan officer, brokerage, including refunds to the client, seller, appraiser, lender, escrow, title company or any other person or company involved with or in the transaction. Kizzow / Cal Mutual standard fees charged on each transaction may include but are not limited to the following:
  1. $275 Administration Fee*
  2. $350 Transaction Coordinator Fee – If there is Real estate representation*
  3. $995 Loan Processing Fee – If there is a Kizzow / Cal Mutual Mortgage
*$275 administration clerical fee and $350 Transaction Coordinator fee and any other fees incurred by Kizzow or any of it’s affiliated businesses are either reimbursed to Kizzow from buyers agent commission received at closing or paid by the buyer/ borrower at close. Refund is typically paid from buyers agent commission for the property sale, not mortgage commissions. At times and when legally allowed by state and federal laws, portions of the commission may come in whole or part from both or either the buyers agent commission and the mortgage commission received on Kizzow / Cal Mutual Funded loans, including most conventional, High Balance Conventional, various jumbo loans, VA and USDA loans. Refund is never paid from FHA loan commissions. Refunds on Reverse mortgage funded transactions ONLY qualify for any and all state and federal allowable refunds or credits. If those state and federal law allow refunds that allow Kizzow / Cal Mutual refund programs then the refund applies the same as qualified mortgages in all refund programs. Refund is applied to the final closing costs of buyers/borrowers or if other unique applicable terms arise outlined in section 14e of these terms and conditions. Only one refund and refund program applies per transaction. In transactions with multiple buyers / borrowers there is only one refund given towards the final closing of the transaction. Each borrower/ buyer does NOT receive a refund. If buyer / borrower cancels or changes either or both services to another non Kizzow / Cal Mutual real estate brokerage or mortgage provider / lender before contract , during or before close of escrow then refund is either fully voided or reduced to applicable refund in section 14b or 14c of these terms and conditions.
b) Refund details for buyer/borrower clients who want to use ONLY Kizzow / Cal Mutual Real Estate services but do not use Kizzow / Cal Mutual Mortgage services: A predetermined fixed percentage of the buyers agent commission is refunded to the buyer/borrower that use Kizzow / Cal Mutual real estate purchase services ONLY and NOT Kizzow / Cal Mutual mortgage services on the same transaction to purchase a property. Refund is calculated by each individual property sale purchase price multiplied by the FINAL buyers agent commission minus any transaction fees then multiplied by a predetermined fixed percentage. Refund Example: $500,000 purchase x 3% GROSS buyers agent commission -$350 Transaction coordination (ex: possible transaction fee) = $14650 NET commission x 25% = $3662.50 refund. Final commissions and refunds WILL vary. Predetermined fixed refund percentages and fees for buyer / borrower who ONLY uses Kizzow / Cal Mutual real estate services:
  1. Final NET buyers agent commission on the transaction must be 2% or greater to qualify for a refund of 25% of the final buyers agent commission.
  2. Final NET buyers agent commission from 1.01% -1.99% and properties under $250,000 qualify for reduced refund of 15% of the final buyers agent commission.
  3. Final NET buyers agent commissions of 1% or less and properties under $250,000 are only eligible for a $500 max refund.
  4. Final NET buyers agent commissions of $2000 or less are NOT eligible for a refund.
Refund will vary on each transaction calculated by the final buyers agent commission. The average buyers agent commission ranges from 1% – 3%, but can be more or less depending on the MLS listed buyers agent Commission. Commission limits and refund limits do apply. Refund is calculated by NET buyers agent commission. Net commission equals Total FINAL GROSS buyers agent commission less any fees associated with the transaction paid by or from the buyers agent or agent, loan officer, brokerage, including refunds to the client, seller, appraiser, lender, escrow, title company or any other person or company involved with or in the transaction. Kizzow / Cal Mutual standard fees charged on each transaction may include but are not limited to the following:
  1. $275 Administration Fee*
  2. $350 Transaction Coordinator Fee – If there is Real estate representation*
  3. $995 Loan Processing Fee – If there is a Kizzow / Cal Mutual loan
*$275 administration clerical fee and $350 Transaction Coordinator fee and any other fees incurred by Kizzow / Cal Mutual or any of it’s affiliated businesses are either reimbursed to Kizzow / Cal Mutual from buyers agent commission received at closing or paid by the buyer/ borrower at close. Estimated refund amount is not guaranteed and the actual refund amount may vary according to MLS listed buyers agent commission, market conditions and other undetermined or unknown factors. Refund is typically paid from buyers agent commission for the property sale, not mortgage commissions. Refund is applied to the final closing costs of buyers/borrowers or if other unique applicable terms arise outlined in section 14e of these terms and conditions. Non Kizzow / Cal Mutual Mortgages are not applicable to any Kizzow Refund Programs. This includes any mortgage funded by any other company either than Cal Mutual Inc, Cal Mutual or Kizzow. Only one refund and refund program applies per transaction. In transactions with multiple buyers / borrowers there is only one refund given towards the final closing of the transaction. Each borrower/ buyer does NOT receive a refund. If buyer / borrower cancels or changes either or both services to another non Kizzow / Cal Mutual real estate brokerage or mortgage provider / lender before contract , during or before close of escrow then refund is either fully voided or reduced to applicable refund in section 14b or 14c of these terms and conditions. Buyer can apply the Kizzow Concierge program in Section 13d if all other terms of use for the Concierge Real East Service program apply and they wish to not use this refund detailed in section 14b.
c) Refund details for buyers/borrowers who want to use ONLY Cal Mutual Mortgage / Kizzow services and do not use Kizzow / Cal Mutual real estate services: A predetermined fixed percentage of the mortgage amount is refunded to the buyer/borrower that use Kizzow and Cal Mutual mortgage services ONLY and NOT Cal Mutual mortgage real estate services on the same transaction to purchase a property. Refund is calculated by each individual property final loan amount multiplied by a percentage minus any transaction fees then multiplied by a predetermined fixed percentage. Estimated refund amount is not guaranteed and the actual refund amount may vary according to final mortgage amount. Final mortgage amount will vary depending on final rate, loan amount, loan lock, market conditions and any fees. Refund Example: $500,000 mortgage x .25% -$350 Transaction coordination (ex: possible transaction fee) = $900 refund. Final mortgage amounts and refunds WILL vary on each closed mortgage transaction commission. Predetermined fixed refund percentages and fees for buyer / borrower who ONLY uses Kizzow / Cal Mutual mortgage services:
  1. Final mortgage amount on the transaction must be $300,000 or greater to qualify for a refund of .25% of the mortgage amount.
  2. Final mortgage amount on the transaction must be under $299,999 to qualify for a refund of .15% of the mortgage amount.
  3. Final mortgage amount on the transaction must be under $199,999 to qualify for a refund of $500.
  4. Final mortgage amount on the transaction under $100,000 do not qualify for a refund.
Refunds are calculated by final mortgage amount less any fees. Fees may include but are not limited to the following fees associated with the transaction paid by or from the loan officer, lender, broker, brokerage or agent, including refunds to the client, seller, appraiser, lender, escrow, title company or any other person or company involved with or in the transaction. Kizzow / Cal Mutual standard fees charged on each transaction may include but are not limited to the following:
  1. $275 Administration Fee*
  2. $995 Loan Processing Fee – If there is a Kizzow / Cal Mutual Mortgage*

Refund is paid from mortgage commission, mortgage fees, brokerage commission or lender commission when legally allowed by state and federal laws. Non Kizzow / Cal Mutual Mortgages are not applicable to any Kizzow Refund Programs. This includes any mortgage funded by any other company either than Cal Mutual Inc, Cal Mutual or Kizzow. d) Refund details for buyers/borrowers who want to use the Kizzow Make an Offer tool and/or Kizzow Concierge program with or without Kizzow / Cal Mutual mortgage services: The full buyers agent commission less a Kizzow flat fee and applicable any transaction fees is refunded to the buyer/borrower that uses Kizzow and Cal Mutual mortgage Concierge program and/or Make An Offer tool an any transaction to purchase a property. Refund is calculated by buyers agent NET commission received at closing less a Kizzow flat fee and any applicable transaction fees. Refund Example: $500,000 purchase x 3% Gross buyers agent commission -$350 Transaction coordination (ex: possible transaction fee) = $14650 NET commission – $4000 Kizzow Flat Fee = $10650 refund. Final commissions and refunds WILL vary. Predetermined fixed refund percentages and fees for buyer / borrower who uses Kizzow / Cal Mutual Make an Offer Tool and/or Concierge program:
  1. Final NET buyers agent commission on the transaction must be greater than $4000.
  2. Final NET buyers agent commissions at $4000 or less will only receive a $500 refund.
  3. Final NET buyers agent commissions of $2000 or less are NOT eligible for a refund.
Refund is calculated by NET buyers agent commission. Net commission equals the Total MLS listed buyers agent commission less any fees associated with the transaction paid by or from the buyers agent or agent, loan officer, brokerage, including refunds to the client, seller, appraiser, lender, escrow, title company or any other person or company involved with or in the transaction. Kizzow / Cal Mutual standard fees charged on each transaction may include but are not limited to the following:
  1. $275 Administration Fee*
  2. $350 Transaction Coordinator Fee – If there is Real estate representation*
  3. $995 Loan Processing Fee – If there is a Kizzow / Cal Mutual Mortgage

Estimated refund amount is not guaranteed and the actual refund amount may vary according to MLS listed buyers agent commission, market conditions and other undetermined or unknown factors. Refund is typically paid from buyers agent commission for the property sale, not mortgage commissions. At times and when legally allowed by state and federal laws, portions of the commission may come in whole or part from both or either the buyers agent commission and the mortgage commission received on Kizzow / Cal Mutual Funded loans, including most conventional, High Balance Conventional, VA and USDA loans. Refunds are never paid from FHA loan commissions. Reverse mortgage refunds ONLY qualify for any and all state and federal allowable refunds or credits. If, those state and federal law allow refunds that allow Kizzow / Cal Mutual refund programs then the refund applies the same as all qualified mortgages in all refund programs. Only one refund and refund program applies per transaction. In transactions with multiple buyers / borrowers there is only one refund given towards the final closing of the transaction. Each borrower/ buyer does NOT receive a refund. If buyer / borrower cancels or changes either or both services to another non Kizzow / Cal Mutual real estate brokerage or mortgage provider / lender before contract , during or before close of escrow then refund is either fully voided or reduced to applicable refund in section 14b or 14c of these terms and conditions.
e) Additional terms for all Kizzow / Cal Mutual Refund programs: Only one refund program can be used on any transaction. The Kizzow Client appreciation refund OR Real Estate Make an Offer Tool and Concierge Real Estate Services program. These offers cannot be combined. The buyer / borrower has the right to choose either program that best applies to their transaction. Refunds cannot be changed or blended. To participate in any Kizzow client refund programs, a buyer/borrower must not be represented by another licensed real estate professional and must execute a buyer brokerage agreement with Kizzow on terms and conditions satisfactory to Kizzow. Participation by a buyer/borrower in any of the refund program are optional and not mandatory to uses Kizzow and the online services provided. Payment of refunds under any Kizzow refund programs will not be made where prohibited by law. A buyer/borrower participating in any Kizzow refund programs are required to disclose their participation and the existence of the chosen Kizzow Refund to all parties involved in the transaction, including: the seller(s), all real estate brokers and agents, any lenders and any other parties to the transaction. For transactions involving a mortgage, payment of any Kizzow refund shall be made via a credit to the buyer/borrower at closing shown on the HUD-1 or other settlement statement and the amount and acceptability of the refund is expressly subject to review and approval of buyer/borrower lender. In the rare case that a refund is greater than the closing costs, then the remaining balance is applied to a maximum interest rate buy down. If the interest rate cannot be bought down or the transaction is all cash, then the remaining balance of the refund will be paid after close from the real estate division, not the mortgage division by a check to the buyer/borrower on or after closing. Buyers/borrowers should consult their accounting, legal or tax advisors regarding proper treatment of any refund. The arbitration shall be conducted in San Diego, CA. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties. 9. GENERAL
  1. Electronic Communications. You agree that all notices or other communications regarding your account and/or your use of the Site (“Communications”), may be provided to you electronically and you agree to receive all Communications from us in electronic form. You may print a copy of any Communications and retain it for your records. All electronic Communications will be considered just as legally binding as if they were in paper form. 10. Concierge Real Estate Services Details Kizzow Concierge Real Estate Services include the following services, but are not limited to only these services.
  1. Buyers agent NET commission received at closing is refunded to the buyer / borrower at closing less a $4000 flat fee and any other fees. Additional refund details are in Section 14e of these terms and conditions.
  2. Writing the initial offer and all counter offers from a Kizzow agent or Kizzow referred agent.
  3. Buyer/borrower will get a dedicated live agent to Manage the transaction through closing.
  4. A dedicated agent will make ONE visit to any ONE property. Additional visits to any property including the first or any additional properties are $500 each visit to be paid to agent from the cooperating agents commission upon closing. This will result in a lower refund to the buyer.
  5. Assisting in appraisal and inspection.
  6. Closing and compiling closing docs for buyers records.
  7. Online property search capability and agent assistance creating and managing property searches.
  8. Phone and online access to buyers/borrowers Kizzow agent and team.
  9. Does NOT include touring and showing buyer/borrower potential properties. This is the buyer/borrower responsibility to tour properties PRIOR to making offers with a Kizzow agent. If the buyer/borrower needs a full service agent, they can use the Kizzow client appreciation refund program detailed in section 14a-e of these terms and conditions.
Concierge Real Estate Services cannot be applied in conjunction with The Kizzow Client Appreciation Refund or combined with any other Kizzow Refund program, used together in whole or in part. 11. MLS Terms of Use In order to allow you to view homes and their data, our MLS data providers require you to acknowledge that you’re considering Kizzow to become your real estate agent. Before viewing any real estate content made available through Kizzow, you must acknowledge:
  • You are agreeing to work in the capacity of a consumer-broker relationship with Kizzow as defined by applicable state law. You have no obligation to work with Kizzow and you can cancel your account with Kizzow at any time. Any information you obtain from the Redfin website is intended for your personal use and cannot be redistributed or retransmitted for any commercial use.
  • You will not copy, redistribute, or retransmit any of the information provided.
  • You understand and acknowledge that the individual multiple listing service (MLS), supplying the property data, owns such data and you acknowledge the MLS’s copyright to such data.
  • You have a bona fide interest in the purchase or sale of real estate on the Kizzow website.
  • You understand that the information from MLS sources is deemed reliable but not guaranteed.
12. Make an Offer Tool / Service Details Kizzow Make an Offer Tool / Service include the following services, but are not limited to only these services.
  1. A self-service option on Kizzow.com for buyers/borrowers to submit property buying offers to a Kizzow agent or Kizzow referred agent.
  2. A live agent to review, submit and represent you and your offer on your behalf.
  3. Can be used with any Kizzow refund program. See section 14a-e of these terms and conditions for additional refund programs and details.
  4. Make and submit as many offers as a client would like to make.
  5. Does not include an agent to tour properties unless applied with the Kizzow 50% Client appreciation program detailed in section 14a-b of these terms and conditions.
  6. Offers can only be submitted by a Kizzow / Cal Mutual Agent or other registered partner agent. Can be used by or with any outside agent.

e) Additional terms for all Kizzow / Cal Mutual Refund programs: Only one refund program can be used on any transaction. The Kizzow Client appreciation refund OR Real Estate Make an Offer Tool and Concierge Real Estate Services program. These offers cannot be combined. The buyer / borrower has the right to choose either program that best applies to their transaction. Refunds cannot be changed or blended. To participate in any Kizzow client refund programs, a buyer/borrower must not be represented by another licensed real estate professional and must execute a buyer brokerage agreement with Kizzow on terms and conditions satisfactory to Kizzow. Participation by a buyer/borrower in any of the refund program are optional and not mandatory to uses Kizzow and the online services provided. Payment of refunds under any Kizzow refund programs will not be made where prohibited by law. A buyer/borrower participating in any Kizzow refund programs are required to disclose their participation and the existence of the chosen Kizzow Refund to all parties involved in the transaction, including: the seller(s), all real estate brokers and agents, any lenders and any other parties to the transaction. 5. REMEDIES FOR BREACH OF THESE TERMS
  • We may take any action that we deem necessary or appropriate if we believe that any user violates the Terms of Use, infringes any intellectual property right, privacy right or confidentiality principles, threatens anybody’s personal safety or uses offensive language. We may: (i) disclose user’s identity to law enforcement agencies, to any third party claiming violation of their intellectual property or privacy right, (ii) block user’s IP address, notify user’s Internet Site Provider, (iii) suspend or terminate any account on our Site (iv) moderate any content submitted to us, (v) take any other action provided for in these Terms of Use or available under equity or law.
  • Since we cannot ensure that all material submitted to us is accurate and free of third party claims, we assume no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party.
6. DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY

Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall be conducted in San Diego, CA. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties. 9. GENERAL
  1. Electronic Communications. You agree that all notices or other communications regarding your account and/or your use of the Site (“Communications”), may be provided to you electronically and you agree to receive all Communications from us in electronic form. You may print a copy of any Communications and retain it for your records. All electronic Communications will be considered just as legally binding as if they were in paper form. You may revoke your consent to receive Communications electronically, but if you revoke your consent to receive Communications electronically, we reserve the right to terminate your right to use our Site.
  2. Hyperlinks. You may link to our Site, as long as this is done in a fair way that does not negatively affect our reputation or business and does not suggest any form of association where there is none. We reserve the right to request that you withdraw any link and you agree to cooperate with us in causing any unauthorized framing or linking to terminate immediately.
  3. Assignment. We may transfer, assign or subcontract the rights, interests or obligations under these Terms, at our sole discretion, without obtaining your consent.
  4. Severability. Should any part of these Terms of Use be rendered or declared invalid by an appropriate authority, such invalidation of such part or portion of these Terms of Use should not invalidate the remaining portions thereof, and they shall remain in full force and effect.
  5. No Waiver. Enforcement of these Terms of Use is solely in our discretion, and failure to enforce the Terms of Use in some instances does not constitute a waiver of our right to enforce them in other instances.
  6. Prevailing Language. In the event of any discrepancy between the English original version of these Terms and any foreign language translation, the English version prevails.
10. Concierge Real Estate Services Details Kizzow Concierge Real Estate Services include the following services, but are not limited to only these services.
  1. Buyers agent NET commission received at closing is refunded to the buyer / borrower at closing less a $4000 flat fee and any other fees. Additional refund details are in Section 14e of these terms and conditions.
  2. Writing the initial offer and all counter offers from a Kizzow agent or Kizzow referred agent.
  3. Buyer/borrower will get a dedicated live agent to Manage the transaction through closing.
  4. A dedicated agent will make ONE visit to any ONE property. Additional visits to any property including the first or any additional properties are $500 each visit to be paid to agent from the cooperating agents commission upon closing. This will result in a lower refund to the buyer.
  5. Assisting in appraisal and inspection.
  6. Closing and compiling closing docs for buyers records.
  7. Online property search capability and agent assistance creating and managing property searches.
  8. Phone and online access to buyers/borrowers Kizzow agent and team.
  9. Does NOT include touring and showing buyer/borrower potential properties. This is the buyer/borrower responsibility to tour properties PRIOR to making offers with a Kizzow agent. If the buyer/borrower needs a full service agent, they can use the Kizzow client appreciation refund program detailed in section 14a-e of these terms and conditions.
Concierge Real Estate Services cannot be applied in conjunction with The Kizzow Client Appreciation Refund or combined with any other Kizzow Refund program, used together in whole or in part. 11. MLS Terms of Use In order to allow you to view homes and their data, our MLS data providers require you to acknowledge that you’re considering Kizzow to become your real estate agent. Before viewing any real estate content made available through Kizzow, you must acknowledge:
  • You are agreeing to work in the capacity of a consumer-broker relationship with Kizzow as defined by applicable state law. You have no obligation to work with Kizzow and you can cancel your account with Kizzow at any time. Any information you obtain from the Redfin website is intended for your personal use and cannot be redistributed or retransmitted for any commercial use.
  • You will not copy, redistribute, or retransmit any of the information provided.
  • You understand and acknowledge that the individual multiple listing service (MLS), supplying the property data, owns such data and you acknowledge the MLS’s copyright to such data.
  • You have a bona fide interest in the purchase or sale of real estate on the Kizzow website.
  • You understand that the information from MLS sources is deemed reliable but not guaranteed.
12. Make an Offer Tool / Service Details Kizzow Make an Offer Tool / Service include the following services, but are not limited to only these services.
  1. A self-service option on Kizzow.com for buyers/borrowers to submit property buying offers to a Kizzow agent or Kizzow referred agent.
  2. A live agent to review, submit and represent you and your offer on your behalf.
  3. Can be used with any Kizzow refund program. See section 14a-e of these terms and conditions for additional refund programs and details.
  4. Make and submit as many offers as a client would like to make.
  5. Does not include an agent to tour properties unless applied with the Kizzow 50% Client appreciation program detailed in section 14a-b of these terms and conditions.
  6. Offers can only be submitted by a Kizzow / Cal Mutual Agent or other registered partner agent. Can be used by or with any outside agent.
13. Get approved / Mortgage application Details Kizzow Get approved / Mortgage application Service include the following services, but are not limited to only these services.
  1. Complete and submit a full or partial mortgage application
  2. Get a loan approval
  3. Work with a dedicated licensed loan officer.
  4. Track the loan process and upload documents
  5. Work in conjunction with your dedicated real estate agent and loan officer.
  6. Update loan approvals and purchase offers.
  7. Can be used with any Kizzow refund program.
14. Refund(s) Details a) Kizzow Client Appreciation Refund *Final refunds will ALWAYS vary from examples and any refunds presented anywhere on Kizzow.com or it’s advertising. **Buyer/borrower must use Kizzow / Cal Mutual for both real estate and mortgage services on the same transaction to buy a property and close the transaction. Non Kizzow / Cal Mutual mortgages are not applicable to any Kizzow refund programs. This includes any mortgage funded by any other company other than Cal Mutual Inc, Cal Mutual or Kizzow. A predetermined fixed percentage of the buyers agent commission is refunded to the buyer/borrower that use Kizzow / Cal Mutual for BOTH their real estate purchase and mortgage on the same transaction to buy a property. Refund is calculated by each individual property sale purchase price multiplied by the FINAL buyers agent commission minus any transaction fees then multiplied by a predetermined fixed percentage. Refund Example: $500,000 purchase x 3% Gross buyers agent commission -$350 Transaction coordination (ex: possible transaction fee) = $14650 NET commission x 50% = $7325 refund. b) Refund details for buyer/borrower clients who want to use ONLY Kizzow / Cal Mutual Real Estate services but do not use Kizzow / Cal Mutual Mortgage services: A predetermined fixed percentage of the buyers agent commission is refunded to the buyer/borrower that use Kizzow / Cal Mutual real estate purchase services ONLY and NOT Kizzow / Cal Mutual mortgage services on the same transaction to purchase a property. Refund is calculated by each individual property sale purchase price multiplied by the FINAL buyers agent commission minus any transaction fees then multiplied by a predetermined fixed percentage. Refund Example: $500,000 purchase x 3% GROSS buyers agent commission -$350 Transaction coordination (ex: possible transaction fee) = $14650 NET commission x 25% = $3662.50 refund. Buyer can apply the Kizzow Concierge program in Section 13d if all other terms of use for the Concierge Real East Service program apply and they wish to not use this refund detailed in section 14b.
c) Refund details for buyers/borrowers who want to use ONLY Cal Mutual Mortgage / Kizzow services and do not use Kizzow / Cal Mutual real estate services: A predetermined fixed percentage of the mortgage amount is refunded to the buyer/borrower that use Kizzow and Cal Mutual mortgage services ONLY and NOT Cal Mutual mortgage real estate services on the same transaction to purchase a property. Refund is calculated by each individual property final loan amount multiplied by a percentage minus any transaction fees then multiplied by a predetermined fixed percentage. Estimated refund amount is not guaranteed and the actual refund amount may vary according to final mortgage amount. Final mortgage amount will vary depending on final rate, loan amount, loan lock, market conditions and any fees. Refund Example: $500,000 mortgage x .25% -$350 Transaction coordination (ex: possible transaction fee) = $900 refund. Final mortgage amounts and refunds WILL vary on each closed mortgage transaction commission. Predetermined fixed refund percentages and fees for buyer / borrower who ONLY uses Kizzow / Cal Mutual mortgage services:
  1. Final mortgage amount on the transaction must be $300,000 or greater to qualify for a refund of .25% of the mortgage amount.
  2. Final mortgage amount on the transaction must be under $299,999 to qualify for a refund of .15% of the mortgage amount.
  3. Final mortgage amount on the transaction must be under $199,999 to qualify for a refund of $500.
  4. Final mortgage amount on the transaction under $100,000 do not qualify for a refund.

d) Refund details for buyers/borrowers who want to use the Kizzow Make an Offer tool and/or Kizzow Concierge program with or without Kizzow / Cal Mutual mortgage services: The full buyers agent commission less a Kizzow flat fee and applicable any transaction fees is refunded to the buyer/borrower that uses Kizzow and Cal Mutual mortgage Concierge program and/or Make An Offer tool an any transaction to purchase a property. Refund is calculated by buyers agent NET commission received at closing less a Kizzow flat fee and any applicable transaction fees. Refund Example: $500,000 purchase x 3% Gross buyers agent commission -$350 Transaction coordination (ex: possible transaction fee) = $14650 NET commission – $4000 Kizzow Flat Fee = $10650 refund. Final commissions and refunds WILL vary. Predetermined fixed refund percentages and fees for buyer / borrower who uses Kizzow / Cal Mutual Make an Offer Tool and/or Concierge program:
  1. Final NET buyers agent commission on the transaction must be greater than $4000.
  2. Final NET buyers agent commissions at $4000 or less will only receive a $500 refund.
  3. Final NET buyers agent commissions of $2000 or less are NOT eligible for a refund.

e) Additional terms for all Kizzow / Cal Mutual Refund programs: Only one refund program can be used on any transaction. The Kizzow Client appreciation refund OR Real Estate Make an Offer Tool and Concierge Real Estate Services program. These offers cannot be combined. The buyer / borrower has the right to choose either program that best applies to their transaction. Refunds cannot be changed or blended. To participate in any Kizzow client refund programs, a buyer/borrower must not be represented by another licensed real estate professional and must execute a buyer brokerage agreement with Kizzow on terms and conditions satisfactory to Kizzow. Participation by a buyer/borrower in any of the refund program are optional and not mandatory to uses Kizzow and the online services provided. Payment of refunds under any Kizzow refund programs will not be made where prohibited by law. A buyer/borrower participating in any Kizzow refund programs are required to disclose their participation and the existence of the chosen Kizzow Refund to all parties involved in the transaction, including: the seller(s), all real estate brokers and agents, any lenders and any other parties to the transaction. For transactions involving a mortgage, payment of any Kizzow refund shall be made via a credit to the buyer/borrower at closing shown on the HUD-1 or other settlement statement and the amount and acceptability of the refund is expressly subject to review and approval of buyer/borrower lender. In the rare case that a refund is greater than the closing costs, then the remaining balance is applied to a maximum interest rate buy down.
